Rock Pulse Web Solutions offers the following professional services:

  • WordPress Website Development: Design, development, and deployment of websites using the WordPress platform.
  • Custom Web Development: Bespoke website and web application development tailored to client specifications.
  • E-Commerce Website Development: Creation and configuration of online stores, including payment gateway integration and product management.
  • Website Audit and Optimization: Comprehensive analysis and improvement of website performance, security, SEO, and user experience.

The specific scope, deliverables, and timelines for your project will be detailed in a separate Statement of Work (SOW) or project proposal.

2. Client Responsibilities

To ensure timely and successful project delivery, you agree to:

  • Provide all required content, images, branding assets, and access credentials in a timely manner.
  • Ensure you have the legal rights to all materials supplied to us.
  • Review and approve deliverables within the agreed timeframes.
  • Respond promptly to requests for feedback, clarification, or additional information.
  • Make payments as specified in your project agreement or invoice.

3. Project Process and Deliverables

  • All projects begin with a discovery and planning phase, followed by design, development, testing, and deployment.
  • You will receive opportunities to review and request revisions at key project milestones, as outlined in your SOW.
  • The number of revision rounds included will be specified in your SOW; additional revisions may incur extra charges.
  • Final deliverables will be provided upon receipt of full payment.

4. Payment Terms

  • A non-refundable deposit (typically 30-50% of the total project fee) is required to commence work.
  • Milestone payments may be required as specified in your SOW.
  • The final balance is due upon project completion and before the website is launched or files are delivered.
  • Late payments may incur interest charges of 1.5% per month and may result in suspension of services or withholding of deliverables.

5. Intellectual Property

  • Upon full payment, you will own the final website or deliverables, excluding any third-party components, plugins, or proprietary tools used in development.
  • We retain the right to display completed projects in our portfolio and marketing materials unless otherwise agreed in writing.
  • You are responsible for obtaining and maintaining licenses for any third-party software, plugins, or stock assets used in your project.

6. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information disclosed during the project, except as required to perform the services or as required by law.

7. Warranties and Disclaimers

  • We warrant that our services will be provided in a professional and workmanlike manner.
  • We do not warrant that your website will be error-free or uninterrupted, nor do we guarantee specific business outcomes, search engine rankings, or sales.
  • Except as expressly stated, all services are provided “as is” and we disclaim all other warranties, express or implied.

8. Limitation of Liability

To the maximum extent permitted by law, Rock Pulse Web Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data. Our total liability for any claim shall not exceed the amount paid by you for the services in the twelve (12) months preceding the claim.

9. Third-Party Services and Integrations

  • Our services may include the use or integration of third-party platforms (such as WordPress, WooCommerce, payment gateways, analytics tools, etc.).
  • We are not responsible for the functionality, security, or availability of third-party services or plugins.
  • Use of third-party services is subject to their own terms and conditions.

10. Website Audit and Optimization

  • Our audit and optimization services are advisory in nature. While we strive to improve your website’s performance, security, and SEO, we do not guarantee specific results or rankings.
  • Implementation of recommendations may require additional work or third-party services, which may incur extra costs.

11. Termination

  • Either party may terminate the project with written notice if the other party breaches these Terms and fails to remedy the breach within fifteen (15) days.
  • Upon termination, you are responsible for payment for all work completed up to the date of termination.
  • We reserve the right to suspend or terminate services for non-payment or violation of these Terms.

12. Changes to Terms

We may update these Terms from time to time. Changes will be posted on our website with a new effective date. Your continued use of our services after changes are posted constitutes your acceptance of the new Terms.

13. Governing Law
